Overview
HIPAA, otherwise known as the Health Insurance Portability and Accountability Act, was first introduced in 1996. It required the Department of Health and Human Services (HHS) to create specific regulations to protect the security and privacy of health information. To fulfill this requirement, the HHS published two key rules: the HIPAA Security Rule and the HIPAA Privacy Rule.
The HIPAA Rules
Privacy Rule
The Privacy Rule, otherwise referred to as the Standards for Privacy of Individually Identifiable Health Information, establishes the national standards that should be used to protect health information. It defines the conditions under which covered entities may use or disclose protected health information (PHI) and grants individuals rights over their own health data.
Security Rule
The Security Rule addresses the non-technical and technical safeguards that covered entities must have in place to ensure that individuals' electronic protected health information (e-PHI) remains secure. It requires covered entities to implement administrative, physical, and technical controls proportional to the risks they face.
